Mid-Atlantic Storage Terms
1. Use of outside contractors and/or persons other than the boat owner is STRICTLY
PROHIBITED without prior written permission from MARINEMAX.
(a) Any major repairs to be done in conjunction with such written permission must
be performed during the yard’s normal working hours.
(b) The boat owner warrants that any outside contractor or person performing such
work maintains insurance coverage sufficient to satisfy the type and amount required
by MARINEMAX.
(c) The boat owner agrees to accept full responsibility for the actions of such
persons or organizations and the owner agrees to indemnify and hold harmless forever
MARINEMAX for any and all claims that may arise from work performed and/or the actions
of those contractors.
2. All boat owners MUST MAINTAIN THEIR OWN INSURANCE COVERAGE to protect against
liability, theft, pilferage, fire, wind storm, snow storm, vandalism or other casualty
or loss.
3. It is expressly agreed by the boat owner that MARINEMAX is not in any way an
insurer of the owner’s property or family, invites, employees or relatives. MARINEMAX
shall not be liable for personal injury, loss of life, property damage to the described
boat, motor, accessories or content thereof, due to fire, theft, vandalism, collision,
freeze damage, wind storm, snow storm, rain, hurricane, or other casualty, loss
or negligence of MARINEMAX, its employees or agents.
4. All boats stored at MARINEMAX are required to have an approved fitted canvas
or shrink wrap cover.
5. MARINEMAX reserves the right to store boats on our premises in the manner most
beneficial to the space available.
6. All personal and accessory articles and/or equipment which you wish to remove
MUST BE TAKEN OFF THE BOAT BEFORE THE STORAGE PROCEDURE IS STARTED. If it is later
requested to be done, we reserve the right to bill on an hourly basis. We require
that ALL electronics and personal property, dock lines, canvas, power cords, valuables,
etc be removed as MARINEMAX is not responsible for any property left on the boat.
7. All storage boats must be removed by June 1, 2008 or a $30 per day storage charge
will be added for each day thereafter. After 10 days, we have the right to place
the boat back in storage. Applicable charges for transportation and blocking will
apply, if required.
8. In the event of litigation, all attorney fees are the responsibility of the boat
owner.
9. WE ASSUME NO RESPONSIBILITY for failure to repair any vessel at a certain time
or date. However, MARINEMAX will exercise reasonable diligence to accomplish same.

MarineMax holds the right to charge outside of advertised pricing. Please contact
your local MarineMax Service Center for complete details and where applicable.
Not all maintenance services can be performed at the time of Winterization.
Customers are encouraged to schedule these services as soon as possible. Pricing
may vary due to model and/or application. Prior to Winterization, your boat’s holding
tanks must be empty and it is recommended that the fuel tanks be ¾ filled. Contact
your local MarineMax Service Center for scheduling and additional information.
I agree that MarineMax is not responsible for items left over the winter which
are missing due to theft or breaking & entering. We highly suggest that these
items be removed when the boat is delivered to MarineMax. This should include, but
not be limited to, VHF Radios, Sounders, Stereos, GPS, Televisions, and other electronics
that can be removed.
